Can’t I just “take over” the home loan?
Unfortunately you cannot just “take over” the mortgage in Australia.
You’ll need to refinance the loan to a new loan that is in the name of the person who will retain ownership of the property.
How much can I borrow?
If you have been making your repayments on time and you meet all standard bank criteria then we can help you qualify for a 95% home loan. However if you’re borrowing over 80% of the property value then Lenders Mortgage Insurance (LMI) will be applicable.
You can also borrow more than 95% if you can get someone like a parent to guarantee your loan.
Is this a purchase or a refinance?
Getting a home loan to pay out a divorce settlement, property settlement or separation agreement is assessed by lenders as both a purchase and a refinance. This means that lenders will assess your loan application in a different manner, applying different lending criteria.
This means that you will need to prove that you have the funds to pay out your partner, if there is not sufficient equity in the property. This is just like a loan for a purchase.
